This document is an electronic record in terms of Information Technology Act, 2000 and rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 and as amended from time to time, that require publishing the rules and regulations, privacy policy and Terms of Use for access or usage of www.dairyFARMING.com website and dairyFARMING application for mobile and handheld devices.
1. These terms of use (the "Terms of Use") governs Dairy farmer’s use of the Customer/dairy farmerof our website www.dairyFARMING.com (the " dairyFARMING website") and our " dairyFARMING " application for mobile and handheld devices (the "App"). The DairyFARMING website and the App are jointly referred to as the "Platform". Please read these Terms of Use carefully before using the Services. If Customer/dairy farmerdoes not agree to these Terms of Use, the Customer/dairy farmermay not use the Services on the Platform, and DairyFARMING requests the Customer/dairy farmerto uninstall the App. The said contract is to take effect on the date on which the Customer/dairy farmerdownloads, installs and pays the subscription amount for the Platform to be used, the Customer/dairy farmersignifies to have acceptance to these Terms of Use and other DairyFARMING Policies (which includes the Cancellation & Refund Policy, Privacy Policy and Take Down Policy) as posted on the Platform and amended from time to time. The downloads, installation and payment of the subscription amount by the Customer/dairy farmercreates a legally binding arrangement between the Company and the Dairy farmer.
2. The Platform is owned and operated Star Bovine Farm Management Private Limited (‘Company’), a private limited company incorporated under the Companies Act, 1956 and having its registered office at D.No. 8-3-167/A/55/7, Flat No. 102, Joy Square Jewel, Vikaspuri, ESI, Hyderabad – 500038, Telangana, India. The Company shall only enable coordination of transactions on its Platform between participating Service Providers and Dairy farmer/dairy farmers.
3. For the purpose of these Terms of Use, wherever the context so requires, "Customer/dairy farmer" or “User” or “you”, shall mean the same and shall mean any natural or legal person who shall do transaction on the Platform by providing registration data while registering on the Platform as a registered user using any computer systems. The terms "we", "Us" or "Our", “DairyFARMING’ or “Company” shall mean Star Bovine Farm Management Pvt. Limited.
4. The Company shall enter into a separate agreement with the Service Providers, to facilitate in providing their list of Services on the Platform. The participating Veterinarians shall be collectively referred to as the ‘Service Provider’ or “Service Provider s”.
5. The Company shall provide services to the Dairy farmers through its Service Providers on the Platform, the Service Providers shall provide Livestock services i.e., dairy farming services, herein after referred to as ‘Veterinary Services/livestock services/ dairy farming services’. The Service Provider shall provide the services of consultancy support in the verticals of feed & fodder management, farm management, heat stress management, help the breed improvement strategy, reminders for Vaccinations, Deworming, Medical check-ups, Artificial Insemination and Pregnancy Diagnosis, herein after referred to as ‘Service Provider Services’. Both Veterinary Services and Service Provider Services shall be collective referred to as ‘Services’.
6.1. The Customer/dairy farmer can avail the dairyFARMING app Services in the form of two subscription models namely
6.1.1. Service Provider Services for a term of half year
a. The Customer/dairy farmer can avail one Service Provider Services for a term of 6 months for a subscription of Rs. 199/-(Rupees One ninety nine only).
b. Each subscription shall be only for one dairy animal at a time.
7.1.2. Service Provider Services for a term of one year
a. The Customer/dairy farmer can avail one Service Provider Services for a term of 12 months for a subscription of Rs. 399/-(Rupees three ninety nine only).
b. Each subscription shall be only for one dairy animal at a time.
8. The subscription amounts mentioned hereabove are inclusive for timely reminders for Vaccinations, Deworming, Medical check-ups, Artificial Insemination, Pregnancy Diagnosis, consultancy support in the verticals of feed & fodder management, farm management, heat stress management and to provide help the breed improvement strategy.
9. The Customer/dairy farmer can choose and raise requests ("Service Requests") from the said Services listed on the Platform.
10. The Service Providers are in association with Company on a voluntary, nonexclusive, and principal to principal basis to provide Services. Partners are free to determine their timings of work. The Company does not exercise control on the Partners and the relationship between the Partners and Company are not that of an agent and principal or employee and employer.
11. These Terms of Use are subject to modifications. The Company reserves the right to modify or change these Terms of Use and other DairyFARMING app Policies at any time by posting modified documents on the Platform and notifying Customer/dairy farmer of the same. Customer/dairy farmer shall be liable to be updated of such changes, if any, by accessing the same. Dairy farmers shall, at all times, be responsible for regularly reviewing the Terms of Use and the other DairyFARMING Policies and note the changes made on the Platform.
12. The continued usage of the Platform Services after any change is posted constitutes acceptance of the Customer/dairy farmer of the amended Terms of Use and other DairyFARMING Policies. As long as Customer/dairy farmer complies with these Terms of Use, the Company grants to the Customer/dairy farmer a personal, non-exclusive, non-transferable, limited privilege to access, enter, and use the Platform and the Platform Services.
13. By accepting these Terms of Use, Dairy farmers also accepts and agrees to be bound by the other terms and conditions and DairyFARMING Policies (including but not limited to Cancellation & Refund Policy, Privacy Policy, Take Down Policy) as may be posted on the Platform from time to time.
14.1. DairyFARMING is operating as an online marketplace and assumes the role of facilitator. It is understood that the contract for sale of any Services is strictly bipartite contract between the Partner/ Service Provider and the Dairy farmer. The Company does not at any point of time during any transaction between Customer/dairy farmerand Partner /Service Provider on the Platform interfere with the Services offered by Partner/ Service Provider as the case maybe.
14.2. The Company shall not have any obligations or liabilities in respect of such contract entered into between Customer/dairy farmer and Partner/ Service Provider.
14.3. The Company does not have any control or does not determine or advise or in any way involve itself in the offering or acceptance of such commercial/contractual terms between the Dairy farmers and Partners / Service Providers.
14.4. The Company may, however, offer support services to Partners in respect to Order fulfilment, mode of payment, payment collection and other ancillary services, pursuant to independent contracts executed by Company with the Partner / Service Providers.
14.5. The Company accepts no liability for any errors or omissions, whether on behalf of itself or third parties for any non-performance or breach of any contract entered into between Customer/dairy farmers and Partner / Service Provider s or for any reason whatsoever.
14.6. The Company does not make any representation or warranty with respect to any aspect of the Services being provided by the Partner / Service Providers through the Platform including but not limited to the manner of delivery of the Services by the Partners / Service Provider to the Dairy farmers as the case may be nor legal title, creditworthiness, identity, of any of the Partner / Service Provider. Dairy farmers are advised to independently verify the bonafides of any particular Partner /Service Providers that Customer/dairy farmer choose to deal with on the Platform and use Customer/dairy farmer’s best judgment on that behalf.
14.7. In case of complaints from the Dairy farmer, the Customer/dairy farmer acknowledges that the Partner /Service Provider shall be solely liable for redressing such complaints. In the event the Customer/dairy farmer raises any complaint on any Partner /Service Provider on accessing the Platform, The Company shall assist the Customer/dairy farmer to the best of their abilities by providing relevant information and such details of the Partner/ Service Provider and the specific Order to which the complaint relates, to enable satisfactory resolution of the complaint but cannot guarantee the outcome and timelines for redressal.
15.1. The Customer/dairy farmer agrees, undertake and confirms not to host, display, upload, modify, publish, transmit, store, update or share any information on the Platform that:
(i) belongs to third party to which the user does not have any right;
(ii) is defamatory, obscene, pornographic, paedophilic, invasive of another’s privacy including bodily privacy, insulting or harassing on the basis of gender, libellous, racially or ethnically objectionable, relating or encouraging money laundering or gambling, or otherwise inconsistent with or contrary to the laws in force;
(iii) is harmful to child;
(iv) infringes any patent, trademark, copyright or other proprietary rights;
(v) violates any law for the time being in force;
(vi) deceives or misleads the addressee about the origin of the message or knowingly and intentionally communicates any information which is patently false or misleading in nature but may reasonably be perceived as a fact;
(vii) impersonates another person;
(viii) threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign States, or public order, or causes incitement to the commission of any cognisable offence or prevents investigation of any offence or is insulting other nation;
(ix) contains software virus or any other computer code, file or program designed to interrupt, destroy or limit the functionality of any computer resource and
(x) is patently false and untrue, and is written or published in any form, with the intent to mislead or harass a person, entity or agency for financial gain or to cause any injury to any person.
15.2. The Customer/dairy farmer shall not use any "deep-link", "page-scrape", "robot", "spider" or other automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy or monitor any portion of the Platform or any Content, or in any way reproduce or circumvent the navigational structure or presentation of the Platform or any Content, to obtain or attempt to obtain any materials, documents or information through any means not purposely made available through the Platform. DairyFARMING reserves the right to prohibit any such activity.
15.3. The Customer/dairy farmer shall not attempt to gain unauthorized access to any portion or feature of the Platform, or any other systems or networks connected to the Platform or to any server, computer, network, or to any of the services offered on or through the Platform, by hacking, "password mining" or any other illegitimate means.
15.4. The Customer/dairy farmer shall not probe, scan or test the vulnerability of the Platform or any network connected to the Platform nor breach the security or authentication measures on the Platform or any network connected to the Platform.
15.5. The Customer/dairy farmer shall not reverse look-up, trace or seek to trace any information on any other user of or visitor to Platform, or any other Customer/dairy farmer, including any account on the Platform not owned by Customer/dairy farmer, to its source, or exploit the Platform or any service or information made available or offered by or through the Platform, in any way where the purpose is to reveal any information, including but not limited to personal identification or information, other than Customer/dairy farmerown information, as provided for by the Platform.
15.6. The Customer/dairy farmer shall not make any negative, denigrating or defamatory statement(s) or comment(s) about us or the brand name or domain name used by us including the name 'dairyFARMING', or otherwise engage in any conduct or action that might tarnish the image or reputation, of DairyFARMING or Partner on platform or otherwise tarnish or dilute any dairyFARMING's trade or service marks, trade name and/or goodwill associated with such trade or service marks, as may be owned or used by us.
15.7. The Customer/dairy farmer agrees not to take any action that imposes an unreasonable or disproportionately large load on the infrastructure of the Platform or systems or networks, or any systems or networks connected to the Company.
15.8. The Customer/dairy farmer agrees not to use any device, software or routine to interfere or attempt to interfere with the proper working of the Platform or any transaction being conducted on the Platform, or with any other person's use of the Platform.
15.9. The Customer/dairy farmer agrees not to forge headers or otherwise manipulate identifiers in order to disguise the origin of any message or transmittal Customer/dairy farmer send to us on or through the Platform or any service offered on or through the Platform.
15.10. The Customer/dairy farmer shall not use the Platform or any content on the Platform for any purpose that is unlawful or prohibited by these Terms of Use, or to solicit the performance of any illegal activity or other activity that infringes the rights of Company or others.
15.11. The Customer/dairy farmer shall not engage in advertising to, or solicitation of, other users of the Platform to buy or sell any Services, Services related to that being displayed on the Platform or related to us. The Customer/dairy farmer may not transmit any chain letters or unsolicited commercial or junk email to other users via the Platform. It shall be a violation of these Terms of Use to use any information obtained from the Platform in order to harass, abuse, or harm another person, or in order to contact, advertise to, solicit, or sell to another person other than us without our prior explicit consent.
15.12. The Company reserves the right, but has no obligation, to monitor the materials posted on the Platform. Company shall have the right to remove or edit any content that in its sole discretion violates, or is alleged to violate, any applicable law or either the spirit or letter of these Terms of Use. Notwithstanding this right, the Customer/dairy farmerwill remain solely responsible for the content of the materials posted on the Platform. Please be advised that such Content posted does not necessarily reflect the Company’s views. In no event shall the Company assume or have any responsibility or liability for any Content posted or for any claims, damages or losses resulting from use of Content and/or appearance of Content on the Platform.
15.13. The Company shall have all the rights to take necessary action and claim damages that may occur due to the Customer/dairy farmers involvement/participation in any way on Customer/dairy farmer own or through group/s of people, intentionally or unintentionally in DoS/DDoS (Distributed Denial of Services), hacking, pen testing attempts without our prior consent or a mutual legal agreement.
16.1. The Customer/dairy farmer may access the Platform by paying the subscription amounts as mentioned herein and registering on the Platform by creating an account ("DairyFARMING Account") and becoming a member (" Membership") or the Customer/dairy farmer can also register to join by logging into the Customer/dairy farmer’s account with certain third party Social Networking Sites (‘SNS’) (including, but not limited to, Facebook).
16.2. The Membership is limited for the purpose and are subject to the terms, and strictly not transferable. As part of the functionality of the Platform Services, Customer/dairy farmermay link Customer/dairy farmer’s DairyFARMING Account with Third Party Accounts, by either:
16.2.2. providing Third-Party Account login information of Customer/dairy farmerthrough the Platform; or
16.2.3. allowing access to Third-Party Account of Customer/dairy farmer, as is permitted under the applicable terms and conditions that govern the use of each Third-Party Account.
16.3. The Customer/dairy farmer represents that disclosure of Customer/dairy farmer’s Third-Party Account login information to DairyFARMING and/or granting access to such Third-Party Account (including, but not limited to, for use for the purposes described herein), will not breach any of the terms and conditions that govern Customer/dairy farmer for use of the applicable Third-Party Account and without obligating us to pay any fees or making us subject to any usage limitations imposed by such third party service providers.
16.4. By granting us access to any Third-Party Accounts, the Customer/dairy farmerunderstand the Company will have access, make available and store (if applicable) any content or information that Customer/dairy farmer have provided to and stored in Customer/dairy farmer’s Third-Party Account (" SNS Content") so that it is available on and through the Platform via Dairy farmer’s DairyFARMING Account.
16.5. Unless otherwise specified in these Terms of Use, all SNS Content, if any, will be considered to be Customer/dairy farmer’s content for all purposes of these Terms of Use.
16.6. Depending on the Third-Party Accounts, the Customer/dairy farmer chooses, and subject to the privacy settings that Customer/dairy farmerhas set in such Third-Party Accounts, personally identifiable information that the Customer/dairy farmer posts to the Customer/dairy farmer’s Third-Party Accounts will be available on and through Customer/dairy farmer’s DairyFARMING Account on the Platform.
16.7. Please note that if a Third-Party Account or associated service becomes unavailable or our access to such Third-Party Account is terminated by the third-party service provider, then SNS Content will no longer be available on and through the Platform.
16.8. The Company will create Customer/dairy farmer’s DairyFARMING Account for Customer/dairy farmer’s use of the Platform Services based upon the personal information the Customer/dairy farmer provides. The Company reserves the right to suspend multiple accounts without being liable for any compensation where Customer/dairy farmer have created multiple accounts on the Platform.
16.9. The Customer/dairy farmer agrees to provide accurate, current and complete information during the registration process and update such information to keep it accurate, current and complete.
16.10. The Company reserves the right to suspend or terminate Dairy farmer’s DairyFARMING Account and Customer/dairy farmer’s access to the Services or the Platform Services (i) if any information provided during the registration process or thereafter proves to be inaccurate, not current or incomplete; (ii) if it is believed that Customer/dairy farmer’s actions may cause legal liability for Customer/dairy farmer, other users or us; and/or (iii) if Customer/dairy farmer are found to be non-compliant with the Terms of Use or other DairyFARMING Policies.
16.11. The Customer/dairy farmer is be responsible for safeguarding Customer/dairy farmer’s password. Customer/dairy farmer agrees that the Customer/dairy farmer will not disclose Customer/dairy farmer’s password to any third party and that Customer/dairy farmer will take sole responsibility for any activities or actions under Customer/dairy farmer’s DairyFARMING Account, whether or not Customer/dairy farmer has authorized such activities or actions. Customer/dairy farmer will immediately notify Company of any unauthorized use of Customer/dairy farmer’s DairyFARMING Account.
16.12. Services availed from the Platform are intended for Customer/dairy farmer’s personal use and Customer/dairy farmer represent that the same are not for resale or the Customer/dairy farmer is not acting as an agent for other parties.
17.1. The Platform allows the Customer/dairy farmer to place Orders and upon acceptance of such Orders by the Partner / Service Provider, the Company will, subject to the Terms of Use set out herein, facilitates availability of Services, through Partner / Service Provider.
17.2. The Customer/dairy farmer understands that any Order that he/she places shall be subject to the terms and conditions set out in these Terms of Use subject to the acceptance of Orders by Partner / Service Provider.
17.3. As a general rule, all Orders placed on the Platform and Delivery Services are treated as confirmed, unless cancelled in terms of Cancellation and Refund Policy.
17.4. All payments made against the Orders on the Platform by Customer/dairy farmershall be compulsorily in Indian Rupees acceptable in the Republic of India. The Platform will not facilitate transactions with respect to any other form of currency with respect to the Orders or Services made on Platform.
17.5. Customer/dairy farmer should pay for the subscription in advance by
(i) credit card or debit card or net banking and
(ii) any other RBI approved payment method or UPI (gpay, paytm etc.) at the time of booking an Order
(iii) Wallet like paytm and others. The Customer/dairy farmer understands, accepts and agrees that the payment facility provided by Company is neither a banking nor financial service but is merely a facilitator providing an electronic, automated online electronic payment, receiving payment on booking the service, collection and remittance facility for the transactions on the Platform using the existing authorized banking infrastructure and credit card payment gateway networks. Further, by providing payment facility, Company is neither acting as trustees nor acting in a fiduciary capacity with respect to the transaction or the transaction price.
17.6. Customer/dairy farmer agrees to pay for the total subscription availed on the Platform. The Company will collect the total amount of subscription in accordance with these Terms of Use and the pricing terms set forth in the applicable listing. Please note that the Company cannot control any amount that may be charged to the Customer/dairy farmer by his/her bank related to our collection of the total amount, and Company disclaim all liability in this regard.
17.7. In connection with Customer/dairy farmer’s Order, he/she will be asked to provide customary billing information such as name, billing address and credit card information either to us or our third-party payment processor. Customer/dairy farmer agrees to pay us for the Order placed by Customer/dairy farmer on the Platform, in accordance with these Terms of Use, using the methods described under clause 9(6) above.
17.8. The Customer/dairy farmer hereby authorizes the collection of such amounts by charging the credit card provided as part of requesting the booking, either directly by us or indirectly, via a third-party online payment processor or by one of the payment methods described on the Platform. Once the Order is confirmed Customer/dairy farmer will receive a confirmation email summarizing the confirmed booking.
17.9. The prices for the Services reflected on the Platform, are determined solely by the Partner and are listed based on Partner 's information. Service Fee may change at the time of placing Order due to Partner changing the price without due intimation and such change of price are at the sole discretion of the Partner attributing to various factors beyond control. Disclaimer: Prices on any Services as reflected on the Platform may due to some technical issue, typographical error or misinformation supplied by Partner be incorrectly reflected and in such an event Partner may cancel Customer/dairy farmer’s Order(s).
18. Cancellations and Refunds Please refer to the Cancellation and Refund Policy for cancellation and refunds terms in relation to usage of the Platform for availing Services.
19.1. Persons who are "incompetent to contract" within the meaning of the Indian Contract Act, 1872 including minors, un-discharged insolvents etc. are not eligible to use the Platform. Only individuals who are 18 years of age or older may use the Platform and avail Services. DairyFARMING reserves the right to terminate Customer/dairy farmer’s Membership and / or deny access to the Platform Services if it is brought to Company's notice that Customer/dairy farmer are under the age of 18 years.
19.2. If Customer/dairy farmer choose to use the Platform Services, it shall be Customer/dairy farmer’s responsibility to treat Customer/dairy farmer’s user identification code, password and any other piece of information that DairyFARMING may provide, as part of our security procedures, as confidential and not disclose the same to any person or entity other than us. Company shall at times and at its sole discretion reserve the right to disable any user identification code or password if Customer/dairy farmer have failed to comply with any of the provisions of these Terms of Use.
19.3. Customer/dairy farmer shall at all times be responsible for the use of the Services through Customer/dairy farmer’s computer or mobile device and for bringing these Terms of Use and DairyFARMING Policies to the attention of all such persons accessing the Platform on Customer/dairy farmerr computer or mobile device.
19.4. Customer/dairy farmer understand and agree that the use of the Services or Platform Services does not include the provision of a computer or mobile device or other necessary equipment to access it. Customer/dairy farmer also understand and acknowledge that the use of the Platform requires internet connectivity and telecommunication links. Customer/dairy farmer shall bear the costs incurred to access and use the Platform and avail the Services, and Company shall not, under any circumstances whatsoever, be responsible or liable for such costs.
19.5. Customer/dairy farmer agrees and grants permission to Company to receive promotional SMS and e-mails from DairyFARMING or allied Service Provider. In case Customer/dairy farmer wish to opt out of receiving promotional SMS or email please send a mail to starbovine@gmail.com
20.1. All registration information Customer/dairy farmer submits is truthful, lawful and accurate and that Customer/dairy farmer agrees to maintain the accuracy of such information.
20.2. The Customer/dairy farmer will not use the Platform in any way that is unlawful, or harms us or any other person or entity, as determined in our sole discretion.
20.3. Customer/dairy farmer will not engage in any form of antisocial, disrupting, or destructive acts, including "flaming," "spamming," "flooding," "trolling," and "grieving" as those terms are commonly understood and used on the Internet.
20.4. The Customer/dairy farmer agrees that the Platform may include the analytics collection software that collects certain Analytics. The Platform may retain and use, subject to the terms of its Privacy Policy, information collected by the analytics collection software upon Customer/dairy farmer downloading or using or installation of the Platform. Information such as age, buying trends, preferences and services availed (Hereinafter referred to as ‘Information’ )Customer/dairy farmer expressly consent to the collection, storage and use of such Information by DairyFARMING and Customer/dairy farmer shall not block or disable the analytics collection software module. The Platform will not share Information associated with Customer/dairy farmer with any third parties unless DairyFARMING (i) have Customer/dairy farmer’s consent; (ii) concludes that it is required by law or has a good faith belief that access, preservation or disclosure of such Information is reasonably necessary to protect the rights, property or safety of the Platform, its users or the public; or (iii) provides such information in anonymous or aggregated form.
21. Company does not warrant that the Platform will be compatible with all hardware and software which Customer/dairy farmer may use. Company shall not be liable for damage to, or viruses or other code that may affect, any equipment (including but not limited to Customer/dairy farmer’s mobile device), software, data or other property as a result of Customer/dairy farmer’s download, installation, access to or use of the Platform or Customer/dairy farmer’s obtaining any material from, or as a result of using, the Platform. DairyFARMING shall also not be liable for the actions of third parties.
22. Company does not represent or warranty that the information available on the Platform will be correct, accurate or otherwise reliable.
23. Company reserves the right to suspend or withdraw access to the Platform to Customer/dairy farmer personally, or to all users temporarily or permanently at any time without notice. DairyFARMING may any time at our sole discretion reinstate suspended users. A suspended User may not register or attempt to register with us or use the Platform in any manner whatsoever until such time that such user is reinstated by us.
21.1. In the event the Platform is accessed on a mobile device, it is not associated, affiliated, sponsored, endorsed or in any way linked to any platform operator, including, without limitation, Apple, Google, Android or RIM Blackberry (each being an " Operator").
21.2. Customer/dairy farmers download, installation, access to or use of the Platform is also bound by the terms and conditions of the Operator.
21.3. The Customer/dairy farmer and DairyFARMING acknowledges that these Terms of Use are concluded between DairyFARMING and Customer/dairy farmer and DairyFARMING only, and not with an Operator, and DairyFARMING, not those Operators, are solely responsible for the Platform and the content thereof to the extent specified in these Terms of Use.
21.4. DairyFARMING is solely responsible for providing any maintenance and support services with respect to the Platform as required under applicable law. Customer/dairy farmer and DairyFARMING acknowledge that an Operator has no obligation whatsoever to furnish any maintenance and support services with respect to the Platform.
21.5. Customer/dairy farmer and DairyFARMING acknowledges that DairyFARMING, not the relevant Operator, are responsible for addressing any claims of Customer/dairy farmer or any third party relating to the Platform or Customer/dairy farmerr possession and/or use of the Platform, including, but not limited to: (i) any claim that the Platform fails to conform to any applicable legal or regulatory requirement; and (ii) claims arising under consumer protection or similar legislation.
21.6. Customer/dairy farmer and DairyFARMING acknowledges that, in the event of any third-party claim that the Platform or Customer/dairy farmer’s possession and use of the Platform infringes that third party's intellectual property rights, DairyFARMING, not the relevant Operator, will be solely responsible for the investigation, defence, settlement and discharge of any such intellectual property infringement claim.
21.7. Customer/dairy farmer must comply with any applicable third-party terms of agreement when using the Platform (e.g. Customer/dairy farmer must ensure that Customer/dairy farmer’s use of the Platform is not in violation of mobile device agreement or any wireless data service agreement).
21.8. Customer/dairy farmer and DairyFARMING acknowledges and agree that the relevant Operator, and that Operator's subsidiaries, are third party beneficiaries of these Terms of Use, and that, upon Customer/dairy farmer’s acceptance of these Terms of Use, that Operator will have the right (and will be deemed to have accepted the right) to enforce these Terms of Use against Customer/dairy farmer as a third-party beneficiary thereof.
22.1. dairyFARMING are either the owner of intellectual property rights or have the nonexclusive, worldwide, perpetual, irrevocable, royalty free, sub-licensable (through multiple tiers) right to exercise the intellectual property, in the Platform, and in the material published on it including but not limited to user interface, Customer/dairy farmer format, Order placing process flow and any content thereof.
22.2. Customer/dairy farmer recognizes that DairyFARMING is the registered owner of the word mark ‘DairyFARMING’ and the logo including but not limited to its variants (IPR) and shall not directly or indirectly, attack or assist another in attacking the validity of, or DairyFARMING’s or its affiliates proprietary rights in, the licensed marks or any registrations thereof, or file any applications for the registration of the licensed marks or any names or logos derived from or confusingly similar to the licensed marks, any variation thereof, or any translation or transliteration thereof in another language, in respect of any services and in any territory throughout the world. If Customer/dairy farmer become aware or acquire knowledge of any infringement of IPR, the Customer/dairy farmer shall report the same at brand-protection@bookursalon.co with all relevant information.
22.3. Customer/dairy farmer may print off one copy, and may download extracts, of any page(s) from the Platform for Customer/dairy farmer’s personal reference.
22.4. Customer/dairy farmer must not modify the paper or digital copies of any materials Customer/dairy farmer has printed off or downloaded in any way, and Customer/dairy farmer must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.
22.5. If Customer/dairy farmer takes prints or copy or downloads any part of the Platform in breach of these Terms of Use, Customer/dairy farmer’s right to use the Platform will cease immediately and Customer/dairy farmer must, at DairyFARMING option, return or destroy any copies of the materials Customer/dairy farmer have made.
22.6. DairyFARMING shall process information provided by Customer/dairy farmer in accordance with our Privacy Policy.
22.7. IP and Take Down Policy
22.7.1. DairyFARMING has put in place IP and Take Down Policy (" Take Down Policy") so that intellectual property owners could easily report listings that infringe their right to ensure that infringing intellectual property marks are removed from the site, as they erode trust of the Customer/dairy farmers.
22.7.2. Only the intellectual property rights owner can report potentially infringements or listings through Take Down Policy by way of Notice of infringement. If Customer/dairy farmers are not the intellectual property rights owner, Customer/dairy farmer can still help by getting in touch with the rights owner and encouraging them to contact us.
22.7.3. DairyFARMING does not and cannot verify that Service Providers have the right or ability to provide the listed Services. DairyFARMING is committed to ensure that Services listings do not infringe upon intellectual property rights of third parties once an authorized representative of the rights owner properly reports them to
